£90,000 Awarded in Building Site Accident Claim

The victim, a 57 year old site manager, was working on site when a waste disposal chute was misused and it collapsed on his shoulder from a height of three storeys.
The injury was very severe and has left the victim with permanently restricted arm and shoulder movement. Due to the type of employment and scale of the injury, the claimant was unable to return to work in the same capacity as prior to the incident.
Proceedings were issued and liability was disputed by the employer throughout. It was a complex matter with multiple defendants (the employer and site contractor) and alleged breaches of the construction design and management regulations.
The accident at work claim was contested for more than three years and resulted in an agreed settlement through mediation. The client was awarded £90,000 in compensation for his injury at work.
